Important notice

This Terms of Service (“Terms”) is provided for informational purposes to structure our legal relationship with you. You should have a licensed attorney review these Terms to ensure compliance with your specific jurisdiction before relying on them. By using Kitebots, you agree to these Terms.

1. Acceptance of Terms

By accessing or using Kitebots (the “Service”), you (“Client”) agree to be bound by these Terms. If you do not agree, you must not access or use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. AI services and limitations

Probabilistic nature of AI: The Kitebots platform uses third-party Large Language Models (LLMs) to generate responses. By using the Service, you acknowledge that AI outputs are generated probabilistically and may sometimes be inaccurate, inappropriate, or fabricated (“hallucinations”).

No liability for outputs: Kitebots acts as a technological conduit. You are solely responsible for reviewing, testing, and verifying AI responses before relying on them. To the fullest extent permitted by law, Kitebots disclaims liability for any loss of revenue, reputational harm, or business disruption arising from use of or reliance on AI output.

Prohibited advice: The Service must not be used to dispense regulated legal, financial, or medical advice. You are responsible for compliance with laws applicable to your use case and industry.

3. Acceptable use and abuse mitigation

You agree not to use Kitebots to: (i) upload malicious code, attempt prompt-injection or similar attacks, or reverse-engineer, extract, or bypass proprietary system prompts, security mechanisms, or API protections; (ii) deploy chatbots that generate or promote hate speech, illegal acts, or unlawful explicit content; or (iii) intentionally overload the API or submit traffic at a volume that degrades the Service for other customers.

We may apply rate limiting, throttling, or suspension (with or without notice) where necessary to protect the Service or other users. Serious or repeated violations may result in immediate suspension or termination without refund, to the extent permitted by law and your plan terms.

4. Intellectual property and data ownership

Client data: You retain all intellectual property rights in documents, URLs, and text you upload to train your chatbot (“Knowledge Base”), subject to the license needed for us to provide the Service. You also retain rights in your branding and configuration choices.

Kitebots IP: Kitebots retains all ownership and rights in the software, source code (except your content), user interface, widget design, documentation, and non-client-specific prompts and models infrastructure, subject to your rights in your own materials.

5. Service level and third-party dependencies

We strive for high availability of our proprietary infrastructure. However, the Service depends on third-party LLM API providers (for example OpenAI, Anthropic, or others we may use) and cloud hosting providers. Kitebots is not liable for downtime, latency, or interruptions caused by outages or performance issues of those third parties, or for failures outside our reasonable control. Uptime commitments, if any, are as stated in your subscription plan or order form.

6. User accounts

You must provide accurate account information and are responsible for safeguarding credentials and for all activity under your account. Notify us promptly of unauthorized use.

7. Limitation of liability

To the maximum extent permitted by applicable law, Kitebots shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Service. Our aggregate liability for claims relating to the Service is limited to the amounts you paid us for the Service in the twelve (12) months preceding the claim, except where such limitation is prohibited by law.

8. Changes to these Terms

We may modify these Terms from time to time. We will post the updated Terms and revise the “Last updated” date. Material changes may be communicated by email or an in-product notice where appropriate. Continued use after changes constitutes acceptance unless applicable law requires otherwise.
